Florida House Bill 837 (HB 837) Compliance and CPTED Protection for Multifamily Properties
Under Florida House Bill 837 (HB 837), multifamily residential property owners who implement specific Crime Prevention Through Environmental Design (CPTED) measures gain important protections against liability for third-party criminal acts on their properties. By completing a documented CPTED
assessment conducted by an approved practitioner or law enforcement agency, property owners can achieve "presumption against liability," as outlined in Florida Statute 768.0706(2).
Key CPTED Security Requirements for Florida Properties Include:
Security Cameras: Installation of a security camera system at all entry and exit points, with video footage maintained for at least 30 days, aiding in offender identification.
Parking Lot Lighting: Ensuring parking lots are well-lit with an average intensity of at least 1.8 foot-candles from dusk until dawn, or controlled by automatic lighting sensors.
Enhanced Walkway and Common Area Lighting: Maintaining adequate lighting for walkways, laundry rooms, common areas, and porches, ensuring these spaces are safely illuminated at night.
Secure Doors and Windows: Each dwelling unit door must have a minimum 1-inch deadbolt, and windows, sliding doors, and other access points should be equipped with locking devices.
Controlled Access Gates: Pool areas must feature locked gates with access controlled by a key or fob.
Door Viewers: All unit doors without nearby windows must include a peephole or viewer to enhance resident security.
Additionally, under Section 768.0706(2)(b), multifamily property owners must have a CPTED assessment completed by an approved Florida Crime Prevention Practitioner or law enforcement, updated every three years.
Employee Crime Deterrence Training Required by January 1, 2025By January 1, 2025, property owners are also required to provide comprehensive crime deterrence and safety training for their employees, ensuring that new hires complete this training within 60 days of employment.
